Deposit Requirement: A 50% deposit of the total project cost is required upon signing this agreement to secure your project on our schedule. This deposit is fully refundable if the project is canceled at least 7 days before the scheduled start date. Cancellations made within 7 days of the start date will forfeit the deposit.
Payment Schedule: After installation of concrete or asphalt (if applicable), 30% of the total balance is due, and the remaining balance is due upon project completion during the final walk-through.
Additional Fees: Any agreed-upon changes or additions to the project scope (change orders) that incur additional charges are payable at the time the change is requested. All changes must be documented, agreed upon in writing, and paid before project completion.
Late Payments: A late fee of 1.5% per month may be applied to unpaid balances beyond the due date.
For new court installations, please allow an estimated curing period of 28 days before the final leveling base coat and 100% acrylic color top coat can be applied for both concrete and asphalt surfaces.
Site Access: The client must ensure access to the site, including clearance for machinery and equipment, throughout the project duration.
Permits and Regulations: The client is responsible for obtaining necessary permits, approvals, or easements. Assistance is available upon request, but any related fees are the client’s responsibility.
Utility Marking: The client must arrange for the marking of underground utilities prior to the project start date. The company will not be held responsible for damages to unmarked utilities or irrigation.
Cancellation by Client: If the client cancels the project, the deposit will not be refunded if canceled within 7 days of the start date.
Rescheduling: Requests to reschedule must be made at least 7 days in advance and are subject to availability.
Force Majeure: The company is not liable for delays or cancellations due to weather, natural disasters, or other events beyond our control. In such cases, the client will be notified promptly, and the project will be rescheduled.
Maintenance: The client is responsible for regular maintenance, including cleaning and minor repairs, to preserve the court’s surface and prolong its lifespan. Maintenance packages are available and recommended.
Warranty: A one-year warranty is provided on workmanship for all installations, covering defects arising from improper installation. Material warranties are subject to manufacturer terms and vary by product. The company will assist in any warranty claims, but ultimate responsibility lies with the manufacturer.
Warranty Exclusions: The warranty does not cover damages resulting from misuse, landscaping activities, neglect, improper maintenance, normal wear and tear, or cracking that may result from natural settling, soil conditions, or other environmental factors. The court is not intended for structural support, building, or vehicle use, and any damage resulting from such activities is excluded from warranty coverage.
General: The company is not liable for incidental or consequential damages, including but not limited to, loss of use, loss of revenue, or property damage not caused by our negligence.
Surface Issues: The company is not responsible for cracking, birdbaths, or surface shifts caused by underlying soil conditions, tree roots, or other environmental factors beyond our control.
Mediation and Arbitration: Any disputes arising from this agreement shall first be attempted to resolve through mediation. If unresolved, the dispute will proceed to binding arbitration in the state of Arizona.
Governing Law: This agreement is governed by the laws of the state of Arizona.
The company reserves the right to modify these terms and conditions for future projects. Any changes will be communicated to the client before the project commencement.
